1. About these terms

These terms govern the use of WowRadar, a service operated by Thibaut Pietri (see the legal notice) that generates websites for music releases. By creating an account, you accept these terms.

2. The service

WowRadar lets you create artist profiles and releases (singles, EPs, albums), upload a cover, audio files, lyrics and links, and generate a release website with a player, visualizer, synchronized lyrics, streaming links and anonymous statistics. WowRadar is not a streaming platform, a distributor or a record label: it does not deliver your music to stores and does not collect royalties.

3. Your account

You must be at least 16 years old, or have the permission of a parent or guardian. You are responsible for the accuracy of the information you provide and for keeping your password secret. One account may manage several artists.

4. Your content and your rights

You keep all rights to the content you upload. By uploading content, you confirm that you own it or have obtained every authorisation needed (composers, authors, performers, producers, labels, collecting societies, photographers, designers) to publish it on WowRadar, including allowing visitors to listen to audio files on your page.

You grant WowRadar a non-exclusive, worldwide, free licence to host, reproduce, resize, convert and display this content, only for the purpose of operating and promoting the service (for example featuring your release on the WowRadar homepage). This licence ends when you delete the content, except for promotional material already published.

It is forbidden to publish content that infringes the rights of others or is unlawful, hateful, violent, pornographic, misleading or otherwise harmful. We may disable any release or account that breaks these rules, without notice and without refund, and cooperate with the competent authorities.

5. Price and payment

Creating an account, artists and releases, and previewing a release website is free. Publishing a release costs €9 (VAT included), paid once for that release. There is no subscription and no recurring fee. Payment is made by card through Stripe; the release is published as soon as the payment is confirmed.

6. Right of withdrawal and refunds

Under EU consumer law, you normally have 14 days to withdraw from a distance contract. However, publishing a release is a digital service delivered immediately after payment. When you pay, you expressly request immediate publication and acknowledge that you lose your right of withdrawal once the release is online (article L221-28 of the French Consumer Code).

Deleting a published release, or having it disabled for breaching these terms, does not entitle you to a refund. If the release could not be published because of a technical problem on our side, contact us and we will publish it or refund you.

7. Availability

Hosting of a published release is provided for the entire period during which the WowRadar service is operated, without any renewal or additional fee. WowRadar may change, suspend or discontinue the service; in the event of permanent discontinuation, users will be informed by e-mail beforehand. We do our best to keep the service available at all times, but we cannot guarantee uninterrupted service. We may carry out maintenance or improve the service, including the design of generated websites.

8. Deleting content or your account

You may delete a release, an artist or your account at any time from your dashboard. Deleted content goes offline immediately and is removed from our servers, except payment records we are legally required to keep.

9. Liability

You are solely responsible for the content you publish. WowRadar acts as a hosting provider for this content. Our liability is limited to direct damages and, in any case, to the amounts you paid us over the last twelve months, except in case of gross negligence or as otherwise required by law.

10. Changes to these terms

We may update these terms. The version in force on the day of your payment applies to that payment. Significant changes will be announced by email or on this page.

11. Applicable law

These terms are governed by French law. In case of dispute, please contact us first: we will look for an amicable solution. Consumers may also use a consumer mediator: service-public.gouv.fr. Failing that, the competent French courts will have jurisdiction.
